1. Acceptance of Terms

By accessing and using the OpenClaw website (claw-device.com), documentation, software, and associated services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our Services.

These terms apply to all visitors, users, contributors, and anyone who accesses the Services. Additional terms may apply to specific features such as hardware purchases, community contributions, or API access.

2. Description of Services

OpenClaw provides an open-source AI agent platform for ESP32 microcontrollers. Our Services include:

  • The OpenClaw website, documentation, and blog content
  • Open-source firmware and software available through our GitHub repositories
  • Open-source hardware designs (schematics, PCB layouts, 3D models)
  • A browser-based firmware flasher tool
  • Community features for sharing projects and templates

3. Open Source Licensing

The OpenClaw project consists of multiple components with different licenses:

  • Software (firmware, tools, libraries): Released under the MIT License. You are free to use, modify, and distribute the software for any purpose, including commercial use, subject to the license terms.
  • Hardware designs (schematics, PCB layouts): Released under the CERN Open Hardware License v2 - Permissive (CERN-OHL-P). You are free to study, modify, and manufacture hardware based on these designs.
  • Documentation and website content: Released under Creative Commons Attribution 4.0 International (CC BY 4.0), unless otherwise noted.

The open-source licenses apply to the source code and design files themselves. They do not constitute a warranty, guarantee of support, or obligation to provide maintenance.

4. Use of Website

You may use this website and its content for lawful purposes only. You agree not to:

  • Use the Services for any illegal, harmful, or fraudulent purpose
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • Upload viruses, malware, or other malicious content
  • Scrape or bulk-download content for the purpose of creating competing services
  • Misrepresent your identity, affiliation, or the origin of content you submit
  • Interfere with or disrupt the availability of the Services for other users
  • Use automated tools to interact with the Services in a way that places unreasonable load on our infrastructure

5. User Accounts and Community Content

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By submitting content (projects, SOUL.md templates, comments, forum posts, or other materials) to our community features, you:

  • Retain ownership of your original content
  • Grant OpenClaw a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content on the platform
  • Represent that you have the right to submit the content and that it does not infringe on any third party's rights
  • Agree that your content complies with our Community Guidelines

We reserve the right to remove any content that violates these terms or our Community Guidelines, without prior notice.

6. Hardware Products

Hardware products sold through our website or third-party retailers are intended for development, educational, and hobbyist purposes. By purchasing and using OpenClaw hardware, you acknowledge that:

  • The products are not certified for use in safety-critical applications, medical devices, life-support systems, or any application where failure could result in injury or property damage
  • You are responsible for ensuring compliance with local regulations regarding electronic devices, radio emissions, and electrical safety in your jurisdiction
  • Assembly of hardware kits is performed at your own risk. Follow proper ESD (electrostatic discharge) precautions when handling electronic components

7. Third-Party Services

ESP-Claw integrates with third-party services including AI providers (Anthropic Claude, OpenAI), messaging platforms (Telegram, Discord), and cloud infrastructure (MQTT brokers). Your use of these services is governed by their respective terms of service and privacy policies. OpenClaw is not responsible for the availability, reliability, or terms of third-party services.

8. Intellectual Property

The OpenClaw name, logo, and brand identity are trademarks of the OpenClaw project. While the software and hardware designs are open source, the use of OpenClaw trademarks is restricted to prevent confusion about the origin of products and services. You may not use the OpenClaw name or logo to imply endorsement without prior written permission.

9. Disclaimer of Warranties

THE SERVICES, SOFTWARE, HARDWARE DESIGNS, AND DOCUMENTATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY FIRMWARE OR HARDWARE DESIGN WILL FUNCTION AS DESCRIBED IN ALL CIRCUMSTANCES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPENCLAW AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.

12. Changes to These Terms

We may update these terms from time to time to reflect changes in our Services or applicable laws. Material changes will be communicated through the website. Your continued use of the Services after changes are posted constitutes your acceptance of the updated terms.
